GENERAL TERMS AND CONDITIONS

1. GENERAL PROVISIONS

Ticketportal.hu is an online ticketing system, the online catalogue of Ticketportal HU Kft. (1065 Budapest, Bajcsy-Zsilinszky út 49., Tax Registration No.: 14802678-2-42, Trade Registry Number: 01-09-920573, Registering authority: the Metropolitan Court as Company Registration Court) in which tickets and passes distributed by Hungarian cultural institutions are offered for sale. By selecting tickets on the website of Ticketprotal HU Kft. (hereinafter referred to as Seller) and by making a payment by debit card or via Mobile Purchase or MasterCard Mobile on the associated website of the bank, a purchase agreement is concluded between the Seller and the natural person or company paying the value of the selected ticket(s) (hereinafter referred to as Buyer), pursuant to the terms and conditions set forth herein. Buyer will accept the terms and conditions of the agreement and the provisions of the business terms and conditions by clicking on “Pay” on the page summarizing the purchase details.

2. SUBJECT MATTER OF THIS AGREEMENT

The tickets and passes offered for sale by the Seller whose features, attributes and the payment terms are available on the pages associated with such tickets and passes.

3. IDENTIFICATION OF THE CONTRACTING PARTIES

Seller shall only be held liable for tickets and passes that are selected on the website www.ticketportal.hu or in online catalogues in which the logo and the details of cultural institutions having a contractual relationship with the Seller are clearly identifiable, and which tickets and passes are purchased in accordance with the terms and conditions of purchase specified there or at the event organizer’s website, and which are purchased by using the associated site of the bank, Mobile Purchase or MasterCard Mobile.

Buyer provides its purchase details (name; the address of the purchase, e-mail address, telephone number) by filling out the registration form, and Seller shall be liable for performing its obligations and issuing the invoice in accordance therewith. Any and all liability shall be held by the Buyer for any and all damages arising from providing incorrect or fake data. Seller shall be entitled to delete any obviously fake registrations, and when in doubt, it shall be entitled to verify the Buyer’s authenticity.

The invalidation of any invoice issued on the basis of data provided incorrectly by the buyer and the procedural fee of re-issuing an invoice with the correct data shall be 2500 HUF. Such amount will be billed to the Buyer following its written request of correction and Seller will issue and post the invoice including the correct data following the payment of such amount. The Seller may only receive any request of correction within three working days following the issuance of the invoice.

4. PURCHASE PRICE, PAYMENT AND DELIVERY TERMS

The prices next to the tickets are the purchase prices thereof and they are inclusive of the value added tax. The payment of the purchase price shall only be made in cash, via mobile phone or by debit card, and the latter will take place after being redirected from Seller’s website to the bank’s website which has a contractual relationship with the Seller. Ticketportal HU Kft. will not assume any liability for any possible problems occurring on the payment page of the bank. The success (or the lack thereof) of the transaction is verified by sending our system’s automatic e-mail of confirmation, which includes the reservation number and the purchase ID, and by the appearance of each transaction under the menu item “My orders”. The automatic e-mail of confirmation will be sent to the e-mail address provided by the Buyer. Buyer shall be liable for any and all damages arising from providing an incorrect e-mail address. Ticketportal HU Kft. will issue an electronic invoice on the basis of the purchase details provided by the buyer which invoice will be sent immediately after the payment of the purchase price to buyer’s e-mail address provided by it.

The organizer of the event reserves the right to adjust the purchase price with immediate effect, without any prior notices or without specifying a reason. When paying for a ticket, the prices indicated at the beginning of the ticket purchase transaction shall be paid.


The tickets may be picked up in accordance with the followings: 
• Personally at the customer service office of Ticketportal HU Kft. (1065 Budapest, Bajcsy-Zsilinszky út 49.) and at its partner offices (www.ticketportal.hu/selling_places.aspx), following the payment of the purchase price in cash, within the timeframe specified in the confirmation, 
• As a package delivered by GLS courier service in Hungary, for a handling and shipping fee of 1990 HUF,
• as a postal parcel with international delivery for a handling and shipping fee of 5000 HUF.
• In the event of HOMEticket purchasing: see Section 10.

5. RESERVING TICKETS ON THE INTERNET, PAYMENT AND RECEIPT PERSONALLY

In case of online reservation, following registration, our company will confirm the successful reservation by sending our system’s automatic e-mail of confirmation. The automatic e-mail of confirmation, containing the reservation number as well, will be sent to the e-mail address provided by the Buyer. Buyer shall be liable for any and all damages arising from providing an incorrect e-mail address. Confirmation of successful reservation shall be deemed by the parties as an agreement between the Seller and the Buyer to agree on the purchase of tickets under the following conditions. Following a successful reservation, Buyer may only pick up the successfully reserved tickets in person, within the deadline specified in the e-mail confirming the successful reservation and upon the contemporaneous payment of the purchase price at the registered office of the Seller (1065 Budapest, Bajcsy-Zsilinszky út 49.) or in any partner office of the Seller (sales places). Upon full compliance with these terms, a business transaction will be entered into by and between the parties, under which Seller shall provide the ticket successfully reserved to Buyer. Following the confirmation of a successful reservation - if Buyer fails to personally pick up the ticket in the manner, at the place and within the time specified above and fails to pay the purchase price within the specified time - Seller shall be entitled to cancel the reservation and sell the ticket at its own discretion. In this case, Buyer shall not be entitled to any compensation for damages in relation to the above, therefore Seller shall not assume any liability. A ticket may only be reserved for a particular event subject to the terms and conditions included in the agreement concluded by and between the Seller and the organizer of the event. Parties hereby acknowledge that the organizer of the Event shall be entitled to unilaterally modify the deadline of the sale specified in advance or to suspend the sale. In this case, Seller shall be entitled to unilaterally modify the terms and conditions of sale set out with respect to the pick-up time of reserved tickets, or if the sale of tickets is suspended, to unilaterally cancel the agreement.

The deadline of the reservations shall be 3 days following the date of the reservation, unless specified otherwise by the organizer of the Event. Repeated, even multiple, reservation of seats can be considered as blocking them, preventing access to them by good faith Buyers, disrupting sales, which is not in the best interests of the Seller or the good faith Buyer who intends to actually purchase the ticket and which, indirectly, causes damage both to the Seller, the organizer of the event and good faith Buyers. Considering the above, Buyer acknowledges that such repeated reservations may be cancelled by the Seller or the accounts of Buyers who repeatedly reserve tickets may be deactivated by the Seller following a prior notice sent to the e-mail address of the Buyer provided upon registration.

6. PURCHASING AND PAYING FOR TICKETS VIA DEBIT CARD

When the purchase price of the tickets is paid via bank transfer, the parties may only consider such payment as fulfilled if such amount is debited to the current account specified by the Buyer and if, contemporaneously therewith, a confirmation is sent to the Seller by the bank. If the transaction is unsuccessful for any reason, our company will inform the buyer of the bank's response and the tickets to be purchased will be reserved as described in section 5.

After a successful transaction, our system will send you an automatic e-mail of confirmation in order to verify that your purchase has been successful. The automatic e-mail of confirmation, containing the purchase ID as well, will be sent to the e-mail address provided by the Buyer.

7. PURCHASING AND PAYING FOR TICKETS VIA MOBILE

When the purchase price of the tickets is paid via mobile purchase, the parties may only consider such payment as fulfilled if such amount is debited to the account belonging to the mobile phone number specified by the Buyer and if, contemporaneously therewith, a confirmation is sent to the Seller by the mobile phone service provider. In case of a successful transaction, an SMS will be sent to the Buyer verifying the success of the transaction and a confirmation of the purchased tickets will be sent to the e-mail address provided upon registration to tickerportal.hu. The confirmation e-mail includes the title and date of the performance(s) and the number and the price of the tickets as well. 
In order to successfully purchase tickets, your balance usable for mobile purchases shall at least include the amount of the price of the tickets and the transaction fee (Telekom charges a transaction fee of HUF 65 per ticket).
Tickets may only be purchased for one performance at a time (via only one confirmation). 
In case of Telekom, the total value of the tickets shall be minimum 100 HUF and maximum 50,000 HUF.

8. PURCHASING AND PAYING FOR TICKETS VIA MASTERCARD MOBILE

When the purchase price of the tickets is paid via MasterCard Mobile, the parties may only consider such payment as fulfilled if such amount is debited to the current account registered in the MasterCard Mobile application and belonging to the mobile phone number specified by the Buyer and if, contemporaneously therewith, a confirmation is sent to the Seller by MasterCard Mobile application. 

In case of a successful transaction, a confirmation will be sent to the mobile phone number provided by the Buyer verifying the success of the transaction and a confirmation of the purchased tickets will be sent to the e-mail address provided upon registration to tickerportal.hu. The confirmation e-mail includes the title and date of the performance(s) and the number and the price of the tickets as well.

In order to successfully purchase a ticket, the Buyer shall have a mobile phone on which MasterCard Mobile is installed, a debit card which is registered and activated in the application, and the amount of the purchase shall be available on the debit card belonging to MasterCard Mobile.

9. PURCHASING AND PAYING FOR TICKETS VIA MASTERPASS

Masterpass payment option is provided by OTP Bank Nyrt. for our webshop.

Masterpass is a mobile payment solution that allows a buyer to pay with its smartphone via a debit card previously registered in an application enabling Materpass (OTPay).

In order to carry out the transaction, a smartphone and an application enabling Masterpass with a registered and activated debit card, of course, is necessary on behalf of the buyer.

Unlike in case of traditional online shopping, Masterpass does not require you to provide your debit card details. When making a purchase, confirm the payment on your smartphone by entering the mPIN of your choice.

10. TICKETS PURCHASED IN HOMETICKET

Self-printed tickets may be printed by the buyer following a successful purchase, such tickets cannot be picked up in our offices or via mail. Printed tickets may only be used if the bar code and the individual ID appearing thereon are illegible.

The value of a properly purchased ticket may only be refunded by the Seller if the event is cancelled or postponed. Parties acknowledge that the organizer reserves the right to change the program or the venue. Only the buyer shall be held liable for any and all consequences and damages arising out of the loss, theft, improper printing, copying or multiple printing of self-printed tickets.

In case of self-printed tickets purchased in the HOMETICKET system, in addition to the purchase price, a handling fee of 190 HUF per ticket + 2% of the value of the cart, however, maximum 1390 HUF handling fee per purchase will be charged which shall be paid by the buyer contemporaneously with and in the same way as the purchase price is paid. The handling fee will not be refunded by the Seller if the event is cancelled.

If the Buyer purchases a ticket for Sziget Fesztivál 2019, a separate administration fee will be charged pursuant to the terms and conditions of the organizer, the amount of which shall depend on the type of the ticket: it may be 990, 1000, 1500 or 2100 HUF. The buyer may request further information on such fees at the e-mail address jegy@sziget.hu.

If the cart contains a ticket for Sziget Fesztivál 2019 during the purchasing process, our webshop will not charge any additional handling fee.

11. THE RIGHT OF CANCELLATION

By conducting a purchase as described in Sections 1 and 4, Buyer agrees to the commencement of the performance by the Seller (in case of tickets and passes where delivery by post has been requested) and to consider such performance to be fulfilled (in case of tickets and passes where personal pick-up has been requested). Pursuant to the above, Buyer shall not exercise the right of cancellation following the purchase. The Seller cannot redeem the tickets or refund the purchase price.

12. COMPLAINTS

Complaints may be lodged electronically which will be received at the e-mail address reklamacio@ticketportal.hu. Investigation will take place within 30 working days at the latest. The user will be notified of the conclusion of the complaint via e-mail.

13. DATA PROTECTION

Buyer acknowledges and agrees that Seller will treat the information obtained through online shopping and registration confidential, use it solely for the purpose of fulfilling purchases, and will not transfer such data in any form to any third party other than the cultural institution concerned. By providing personal data, Buyer agrees to the processing of its personal data by the Seller in the manner as described above.

14. MISCALLANEOUS

Only the option of purchase is offered by the Seller for the visitors of the online ticketing system. Reservations may only be accepted if they are carried out in the manner described in Sections 5 and 6. Purchased tickets cannot be redeemed or exchanged for other tickets.

All tickets sold by Ticketportal HU Kft. are equipped with a unique barcode. The Buyer shall treat this barcode confidentially which means it shall prevent the access to them by third parties (e.g. via photos, sharing it in the social media, etc.). Ticketportal HU Kft. shall not be held liable for any and all damages arising out of a possible misuse of the ticket’s barcode due to a failure to comply with the above.

Cultural institutions reserve the right to change the programs. In the event of any change of programs, or if a performance is cancelled, tickets will be redeemed as instructed by the Organizer of which Buyer will be notified via the contact details provided upon registration.

Matters not regulated in this purchase agreement are governed by the provisions of the Civil Code as amended from time to time.

A legal relationship of service provision is concluded between the person purchasing the ticket and the organizer of the event as a result of ticket purchase. It is the event organizer’s responsibility to organize and carry out the event as advertised in which Ticketportal HU Kft. will not participate, and it will not assume any liability for the quality, implementation or cancellation of the event to which the purchased ticket grants access.
